TerraForeman Terms of Service

Agreement and Business Use

These Terms are issued by Terraforeman LLC, doing business as TerraForeman, and govern access to the TerraForeman website, Scout application, company workspaces, subscriptions, and connected features. By creating an account, starting a trial, purchasing a subscription, or using the service, you agree to these Terms and the Privacy Policy. If you use TerraForeman for a company, you represent that you are authorized to accept these Terms for that company. TerraForeman is intended for lawful business use by adults.

The Service

TerraForeman provides contractor-focused tools for leads, estimates, proposals, scheduling, customer communication, invoices, job records, reporting, marketing preparation, connected business services, and AI-assisted work. Features may differ by plan, connected account, location, provider approval, or product stage. Unless a workflow expressly confirms otherwise, generated material is a draft for your review.

AI-Assisted Output and Contractor Responsibility

Scout may generate suggestions, summaries, estimates, advertising language, customer messages, and other content using automated systems. AI output may be incomplete, inaccurate, or unsuitable for a particular job. TerraForeman does not provide legal, tax, engineering, accounting, safety, or permitting advice. You are responsible for reviewing output and for your pricing, measurements, contracts, advertising, permits, utility-location procedures, safety decisions, customer commitments, and compliance with applicable law.

Accounts and Access

Customer access uses supported identity providers such as Google or Facebook. You are responsible for securing those accounts, maintaining accurate account information, and promptly notifying us of suspected unauthorized access. Company owners control which authorized users can access their workspace and are responsible for removing access when a user no longer needs it. You are responsible for activity performed through your company account.

Subscriptions and Billing

Registration requires TerraForeman owner approval. An approved company may start a 30-day Pro trial without creating a Stripe account or providing a payment method. The trial does not automatically convert to a paid subscription unless the company owner separately completes Stripe checkout. Stripe processes payment methods, charges, invoices, and the billing portal; TerraForeman does not store full card numbers.

Paid subscriptions renew monthly until canceled. Company owners can manage payment details and cancel through the Stripe billing portal available from My Account. Cancellation normally takes effect at the end of the current trial or paid billing period, and access may end when that period expires. Charges already incurred are generally non-refundable and are not prorated except when required by law or expressly stated at checkout. Contact us promptly about suspected billing errors. Trial eligibility may be limited to one trial per customer or company.

Stripe is the billing system of record after paid-subscription checkout. When Stripe reports an end-of-period cancellation, TerraForeman sends a confirmation to the billing email on the company account. Email delivery can be affected by filtering, suppression, an invalid address, or a provider outage. The Refund Policy and Cancellation Policy provide additional details.

Scout Usage and Fair Use

Unless a different allowance is displayed for your plan, a company workspace includes up to 1,000 model-generated Scout answers per calendar month. Built-in workflow actions that do not call an AI model may remain available after that allowance is reached. Unused requests do not roll over. Reasonable burst limits, storage limits, upload limits, and abuse controls apply to protect customers and service availability. We may temporarily restrict automated, excessive, unsafe, or unauthorized use and will provide plan or support options when practical.

Customer Data

You retain ownership of information and materials you submit to your workspace. You grant TerraForeman a limited right to host, process, transmit, back up, and display that information only as needed to provide, secure, support, and improve the service and to comply with law. You represent that you have the rights and permissions needed to submit customer information, photos, messages, and other content.

Communications, Advertising, and Connected Services

You decide whether to send messages, publish posts, activate advertising, or spend money. You are responsible for recipient consent, opt-out requirements, advertising claims, targeting choices, platform policies, and applicable email, text-message, privacy, and consumer-protection laws. Do not use TerraForeman for spam, deceptive advertising, unlawful surveillance, discrimination, or unauthorized contact. Google, Meta, Stripe, Twilio, and other connected services are governed by their own terms and may change, suspend, or reject access.

Acceptable Use

You may not access another company's workspace, probe or bypass security controls, share access outside your authorized team, upload malware or unlawful material, interfere with the service, scrape or reverse engineer protected portions of the application, misuse provider credentials, or use TerraForeman to violate law or the rights of another person. We may investigate and suspend access when reasonably necessary to protect the service, customers, or third parties.

Ownership of TerraForeman

TerraForeman, Scout, product copy, workflows, screenshots, designs, software, and related materials are proprietary. These Terms give you a limited, non-exclusive, non-transferable right to use the service during an active trial or subscription. They do not transfer ownership of TerraForeman technology or branding.

Third-Party Services

TerraForeman relies on third parties for hosting, storage, security, billing, sign-in, AI processing, email, optional texting, and business integrations. Your use of those services may be subject to their terms and privacy policies. TerraForeman is not responsible for a third-party outage, account restriction, policy change, or decision outside our reasonable control.

Availability and Changes

We may improve, change, suspend, or discontinue features as the product develops. We work to keep the service available but do not guarantee uninterrupted or error-free operation. Features identified as beta or awaiting provider approval may change or be unavailable to some customers. Material pricing or term changes will be communicated as required before they apply.

Suspension and Ending Access

We may suspend access for nonpayment, security threats, abuse, unlawful activity, or material violations of these Terms. You may cancel through Stripe as described above. Contact us before access ends if you need help exporting information from your workspace. We may retain limited records after termination as described in the Privacy Policy.

Disclaimers and Limitation of Liability

To the maximum extent permitted by law, TerraForeman is provided "as is" and "as available" without a guarantee that every output, integration, estimate, lead, or business result will be accurate or successful. TerraForeman is not responsible for indirect, incidental, special, consequential, or lost-profit damages. To the maximum extent permitted by law, TerraForeman's total liability arising from the service will not exceed the subscription fees paid by the affected customer during the three months before the event giving rise to the claim. These limits do not apply where applicable law does not allow them.

Changes to These Terms

We may update these Terms as the service changes. We will post the updated date and provide additional notice when required by law or when a material change affects an existing paid subscription. Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
